Terms & Conditions

 

Welcome to O’Donovans Delivery. 

Please read these Terms carefully before ordering any Items from our Application. If you have any questions relating to these Terms please contact lorna@odonovansofflicence.com before you place an order. If you are a consumer, you have certain legal rights when you order Items using our Application. You can find more information about these rights at: https://www.citizensinformation.ie/en/consumer_affairs/consumer_protection/consumer_rights/ and from the Competition and Consumer Protection Commission (CCPC), https://www.ccpc.ie. Your legal rights are not affected by these Terms, which apply in addition to them and do not replace them.  By setting up your O’Donovans Delivery account, you confirm that you accept these Terms.

Information About Us

O’Donovan’s Off Licence group is a family owned business. We have been in business for over 40 years. Employing over 80 people locally. With 8 branches, across Cork City and County. Our headquarters are in Little Island, Cork.

We specialise in off licence retail. We have WSET trained staff in all our branches; and we pride ourselves on our customer service. Our dedicated buying team have years of experience, which help to deliver the very best service to our customers.

40 years trading has given us the connections in wine and spirits to share with our customers. We have a huge selection of wines from around the world, allowing us to set trends in wine consumption. 

We have a wide selection of spirits; amongst our stock, we have premium spirits from around the world, they are not normally available, but are specially sourced by our experienced buying team. 

We are also heavily involved in the increasingly growing craft beer industry. We have hundreds of carefully selected craft beers in stock, as well as all the major brands.

Purpose

Our objective is to make the off licence experience easier for you. We offer instore prices from the comfort of your couch, and we endeavour to get your order to you within an hour.

Your Account

Before you can place orders for Items using our Application, you need to open an O’Donovans Delivery account and go through the verify age process. When you open an account you may create a password, or other secure login method, and may also have to provide credit card details. You must keep any password you create, or other secure login method, secret, and prevent others from accessing your email account or mobile phone. If another person uses these methods to access your account, you will be responsible to pay for any Items they order, and we are not responsible for any other losses you suffer, unless the person using your password obtained it because we did not keep it secure.

You may close your account at any time by requesting to do so in your account section or contacting us using the contact details above. We may suspend your access to your account, or close it permanently, if we believe that your account has been used by someone else. We may also close your account if in our opinion you are abusing our Service (for example, by applying for refunds or credit to which we do not consider you are entitled, making repeated unreasonable complaints, mistreating our staff or drivers, or any other good reason). 

Orders

When you place an order through our Application, it needs to be accepted by us before it is confirmed. We will send you a notification if your order has been accepted. The contract for the supply of any Item you have ordered comes into existence when we send the Confirmation Notice. You are responsible for paying for all Items ordered using your account, and for related delivery charges, and for complying with these Terms, even if you have ordered the Item for someone else. We operate a minimum order value policy. This will be displayed on our Application. All Items are subject to availability.  

Delivery

When you place an order with us, we endeavour to get the order to you within an hour.

Unfortunately, despite our best efforts, things do not always go to plan and factors such as traffic and weather conditions may prevent us from delivering your Item on time. 

We will attempt delivery at the address you provide to us when you place your order. You will not be able to change the delivery address once the order is confirmed.

You will still be charged for the Item and for delivery in the event of a failed delivery if you have caused such failure for any reason. Reasons you might cause a delivery to fail include (but are not limited to):  

  • You do not come to the door, did not pick up the phone when the driver contacted you using the contact information you have provided us and/or you picked up the phone but then failed to provide access within a reasonable amount of time.
  • The driver refuses to deliver the Item to you in accordance with section 6 (Age Restricted Products).

 

Age Restrictions

Our products can only be sold and delivered to persons aged 18 or over. You must first complete the age verification process before placing an order. O’Donovans Delivery operates an age verification policy whereby customers ordering must be the person whose ID is uploaded to the app, and must be the person who accepts the delivery at the door. You will be asked by the driver to provide proof that you are the person that placed the order, and to show ID at the door. The driver may refuse to deliver any product to any person unless they can provide valid photo ID proving that they are aged 18 or over. The driver may refuse to deliver alcohol to any person who is, or appears to be under the influence of either alcohol or drugs. If delivery of any age restricted product is refused, you will still be charged for the relevant Item and for delivery.

Cancellation

You may cancel an order without charge at any time before we start processing your order. If you wish to cancel an order before it is dispatched, please contact us immediately, via our Application. If the we confirm the order was not processed, we will refund your payment. If you cancel any order after it has been processed, you will be charged the full price for the Items, and if the driver has been despatched you will also be charged for delivery.  

O’Donovans Delivery may notify you that an order has been cancelled at any time. You will not be charged for any orders cancelled by us and we will reimburse you for any payment already made using the same method you used to pay for your order. Please note depending on bank, this may take 3-4 days to show back into your account.

Prices, Payments and Offers

Prices include VAT. O’Donovans Delivery may operate dynamic pricing some of the time, which means that prices of Items and delivery may change while you are browsing. Prices can also change at any time at our discretion. We reserve the right to charge a Service Fee, which may be subject to change, for the provision of our Services.  You will be notified of any applicable Service Fee and taxes prior to purchase on the checkout page on our Application. O’Donovans Delivery will also charge you a delivery fee. This will be notified to you during the order process before you complete your order.

The total price of your order will be set out on the checkout page on our Application, including the prices of Items and Delivery and applicable Service Fees and taxes.

Payment for all Items and deliveries can be made on our Application by credit or debit card. Once your order has been confirmed your credit or debit card will be authorised and the total amount marked for payment. We cannot accept cash payment.

Data Protection

O’Donovans Off-Licence is committed to protecting your privacy in accordance with the Data Protection Acts of 1988 and 2003 (the “Data Protection Acts”) at all times. If you have any requests concerning your personal information please contact us at info@odonovansofflicence.com

INFORMATION COLLECTED

O’Donovan’s Off Licence collects the details provided by you when you register with us and for any transaction you carry out online. Information such as contact details and payment details at point of sale will be collected. All data i.e. credit card details, will be deleted as soon as the need for it has passed. 

USE OF YOUR INFORMATION AND YOUR PREFERENCES

We will use your contact details to communicate with you and send you news and offers relating to O’Donovan’s Off Licence. We may contact you by email, for these purposes.





DISCLOSURES OF YOUR INFORMATION

The only reason we would pass your personal data i.e. your address, to anybody else, is for delivery purposes only. No other information will be passed on for any other reason.
